These terms and conditions (the Terms) refer to the inheritance tax risk calculator relating to mortality and survival rates (Calculator) provided by Ingenious Capital Management Limited (Ingenious) to assist firms authorised and regulated by the Financial Conduct Authority (FCA) in interpreting the statistics produced by the Office of National Statistics and understanding the probability of a person surviving a variety of time periods, based on their sex and current age. By using the Calculator you are agreeing to be bound by these Terms. If you do not wish to be bound by what you read below, or if you are not an intended recipient firm authorised and regulated by the FCA you should not use the Calculator.
The data provided by the Office of National Statistics sets out survival rates of people at any given age, and the number of people of that age expected to die within one year. This information is used by the Calculator to calculate the number of deaths and survivors over the periods of both seven years and two years, by adding together the numbers stated in the relevant one year periods set out in the data published by the Office of National Statistics. The Calculator utilises data taken from the Office of National Statistics Periodic Life Tables 2011-2013 which takes into account historic data, but it does not take into account predicted future medical advancements.
Whilst the data made available by the Office of National Statistics is generally an accurate guide to the probability of death and survival of the general population over time, neither it nor the Calculator have been independently verified by an actuary nor do they take into account an individual’s specific circumstances. As such Ingenious cannot be held responsible for their accuracy, nor their relevance for the purpose of assessing a particular investor’s risk.
The use of this Calculator is for the intended recipients only, each of whom are reminded that they are responsible for complying with their own obligations under the Financial Services and Markets Act 2000 (the Act). Recipients of this information must ensure that any use made of the information provided fully complies with their obligations under the Act.
Ingenious does not warrant the completeness, truth or accuracy of the information or other content found in the Calculator, or its usefulness for any particular purpose. Recipients acknowledge and agree that they bear full responsibility for their own research and decisions and that Ingenious shall not be liable for any action that the recipient or others take or do not take based on use of or reliance on information provided by the Calculator or the Office of National Statistics data on which it is based.
Ingenious cannot accept any liability for any loss or damage a recipient may suffer or incur: (i) in the event that any product the recipient recommends does not meet the requirements of its client, or is not suitable for the client; or (ii) if any information about the client held by the recipient is not correct, complete and accurate; or (iii) if any information about the client held by the recipient is misleading, or if the recipient has failed to disclose all relevant facts.
Ingenious does not undertake or warrant that access to the Calculator, or its content will be delivered uninterrupted, timely or error-free, or that the Calculator will be free from viruses or other harmful properties. It is the recipient’s responsibility to implement satisfactory safeguards and procedures to make sure any data the recipient obtains through access to the Calculator is free from such contaminations or other harmful properties.
The effect of what is set out here is that the recipient agrees that under no circumstances will Ingenious be held liable for any direct, indirect, incidental or other type of loss or injury resulting from the recipient’s (or its designees’) use, extrapolation, reproduction or downloading of any content from the Calculator, the statistics it interprets or for any consequence arising therefrom.
The inheritance tax risk calculator is for FCA authorised and regulated advisers only and must not be used by retail clients. It has been developed by Ingenious and uses data from the Office of National Statistics to discover the probability of surviving two versus seven years, based on age and gender.
